Terms and Conditions

These terms apply to every order placed on this website. By placing an order you accept them, so please read them once before checking out.

1. Orders and acceptance

An order is a request to supply the item you selected. A contract is formed only when we confirm the order and the payment is successful. We may decline or cancel an order if the item is unavailable, if the delivery address is not serviceable, or if we cannot meet the requested delivery slot, and in that case the full amount is refunded.

2. Prices and payment

All prices are shown in Indian Rupees and include applicable taxes unless stated otherwise. Delivery charges, if any, are shown before you confirm the order. We keep the site available at all times and reserve the right to change prices before you place an order, but never after it is confirmed.

3. Delivery

Delivery is subject to the serviceability of your address. Timings are estimates and are not guaranteed, because they depend on traffic, weather and the recipient being available. If the recipient is unavailable, we attempt a second delivery and any failed delivery charges may apply. We do not deliver alcohol, tobacco or perishable items.

4. Custom and personalised items

Custom cakes, personalised gifts and printed items are made to order. Because they are made specifically for you, they cannot be returned or exchanged once production has started, and any artwork supplied by you must not infringe the rights of others.

5. Food safety and allergens

Our cakes are prepared in a kitchen that also handles wheat, dairy, eggs, nuts and soy. We cannot guarantee that any item is completely free from traces of these allergens. Please tell us about any allergy before ordering and we will do our best to advise you.

6. Intellectual property

The design, layout, text, images and logos of this website belong to The Flying Cakes or to the respective owners. You may not copy, reproduce or republish them without written permission.

7. Limitation of liability

To the extent permitted by law, our liability for any order is limited to the value of that order. We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, epidemics or loss of network.

8. Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Varanasi, Uttar Pradesh.
